Terms and Conditions of Use for RVPsy

Application

Any subscription made with RVPsy constitutes an express and unconditional acceptance of the “Terms and Conditions of Use” which form an essential element of the contract and the mutual agreement between RVPsy and you (hereinafter “the Client”).

The possible nullity of a clause in these general subscription terms shall not render the whole or part of these general subscription terms null; such a clause would be deemed unwritten.

Registration Conditions

In order to access RVPsy the client must provide his/her first name, last name, email address and choose a password.
By clicking the “register” button, the client fully accepts these Terms and Conditions of Use as well as the Site Privacy Policy, which he/she acknowledges having read and understood.
The client also agrees to receive professional emails related to his/her registration. He/she can stop receiving them at any time by clicking the unsubscribe link at the bottom of each email.
By registering, the client agrees that RVPsy generates a public web page mentioning his/her profile. The profile can be made private at any time by unchecking the box provided in the software’s administration panel.

In the absence of registration, leaving an email address on this site – dedicated to professionals – demonstrates interest in RVPsy and the user consents to receive professional emails related to the application. He/she can stop receiving them at any time by clicking the unsubscribe link at the bottom of each email.

Subscription Conditions

All subscription requests are made exclusively online on the site rvpsy.com, excluding any other medium or method.

Prices listed are valid as long as they are visible on the Site. By clicking “Validate my subscription” at the end of the subscription form, the Client makes the subscription binding on RVPsy. The Client receives immediately after payment an email confirming and summarising the subscription.

Price

Price – The prices shown on the Site, by email and during various advertising campaigns of RVPsy are net.
It is specified that these prices are given without commitment and may be changed at any time. The subscription is billed based on the rate in effect at the time of subscription. If, for any reason, an incorrect price is displayed during subscription, only the current price will prevail. If the pricing error results from a mistake by RVPsy, the Client may cancel the subscription.

Payment Conditions

Payment is due at the time of subscription, cash and without discount. RVPsy accepts payment only via PayPal.
When your subscription is processed:
- you receive a confirmation email of your PayPal payment
- your rights to the subscription‑required features are activated within minutes.

Subsequently, at the end of each subscription period, you will be charged the amount necessary to continue your subscription for an identical period.
You may terminate your subscription at any time by selecting “Stop” in the administration panel of your space and following the PayPal cancellation procedure. In any case, amounts already received remain retained by RVPsy.

Although no notice is required to end your subscription, we recommend taking the necessary steps at least 24 hours before renewal to allow all IT and banking procedures to be accounted for.

Payment incidents: In case of a problem with the payment of your subscription or its renewal, the subscription and associated features will be immediately suspended until the Client pays the full price.

Provision

RVPsy is considered to have made the subscription available to the Client when:
- RVPsy (via PayPal) has sent the Client the email confirming the opening of the ordered subscription,
- RVPsy has received PayPal confirmation of the correct payment of the subscription amount.
It is the Client’s responsibility to take all appropriate measures to protect his/her computer equipment, data, files or programs against viruses and to prevent intrusion or hijacking attempts.

Limitations

The SMS appointment reminder feature is limited to 250 SMS per month to French‑speaking countries (France, Belgium, Switzerland, Canada…). Additional SMS can be purchased beyond this limit.
The tablet note‑taking feature is designed for use with an iPad 2018 or later, an iPad Mini 2021 or later, an iPad Air 2019 or later, or any iPad Pro model, together with an Apple Pencil (any generation). Use with other tablets may work but is not officially optimised nor supported.
RVPsy is currently in ‘beta’, meaning it is under development. Some features may be missing, non‑functional, or behave unexpectedly. Please contact us if you encounter any issues.
RVPsy cannot be held responsible for data loss.

Right of Withdrawal

In accordance with Article L121‑20‑2‑1° of the Consumer Code, RVPsy does not grant a right of withdrawal for online subscriptions once the Client has paid for the subscription and RVPsy has made the subscribed features available. The subscription service is deemed performed when the Client has paid for the subscription and RVPsy has provided the subscribed features.

Liability

RVPsy assumes no liability, either towards its Client or any third party, arising from the use of its application.
In case of non‑performance of a subscription, RVPsy’s liability is strictly limited to the amount of the subscription and cannot give rise to any additional compensation.
RVPsy cannot be held liable for direct or indirect damages of any kind, including lost profits or data loss, resulting from the use of its site.
The content of RVPsy complies with French legislation. Therefore, if used outside French territory, it is the Client’s responsibility to ensure beforehand that the subscription does not violate local laws.
RVPsy applies its expertise and technical skills to make the application as available as possible, yet it does not commit to any specific uptime, execution speed or other technical measure.

Data Security

The application is designed to ensure a high level of data security, often far beyond sector practices. Below are some measures implemented, though not necessarily exhaustive:
- complete encryption of communications between the Client’s device and our servers (HTTPS).
- passwords are never stored in plain text in our databases.
- personal and identifying data of the Client’s customers (e.g., name, surname, postal address…) are stored encrypted in our databases.
- files uploaded by the Client and stored in the application are systematically encrypted and are decrypted only when accessed by the properly identified Client.

Nevertheless, RVPsy does not possess any certification or authorisation allowing it to store sensitive medical data. By accepting the general subscription conditions, the Client therefore commits not to store medical‑related data that could affect his/her own customers.

Use of Data

Regarding your account:
By creating an account on RVPsy you agree that the data concerning you (e.g., name, surname, email…) may be used for commercial communication purposes, notably so that we can discuss the evolution of RVPsy with you.

Regarding the data you store in RVPsy:
- For the proper execution of certain application features we may need to transmit some information to our technical partners. For example, SMS appointment reminders involve transmitting a phone number, appointment date and time, and your name to our SMS service provider. We strive to limit transmitted information to the strict minimum and do so securely. Moreover, our partners have no right to use this data without our consent.
- To optimise the application’s functionalities, we may perform various computational and statistical processing of the data stored in RVPsy; these processes are always anonymised.
- The personal and identifying data of your customers will never be used for commercial prospecting.

Force Majeure – Fortuitous Events

Considered fortuitous events or force majeure, relieving RVPsy of any obligation to act, are strikes, civil or foreign war, riots, acts of terrorism, total or partial destruction of premises and production facilities or others, manufacturing incidents, transport disruptions, supply difficulties, customs measures of any kind, Internet outages, telecommunication interruptions, or any other unforeseen event that wholly or partially prevents or delays the fulfilment of RVPsy’s obligations.

Intellectual Property

All data of the RVPsy application are protected by international intellectual‑property laws and conventions.
Any unauthorised reproduction, modification or use may result in criminal and civil proceedings.

Trademarks / Mentions

Any mention or use of trademarks, names, acronyms, logos, colours, graphics or other elements licensed to or owned by RVPsy is strictly prohibited unless prior written approval from RVPsy is obtained.

Jurisdiction Clause / Attribution of Jurisdiction

These general subscription conditions and the contracts to which they apply are governed by French law.
French courts shall have exclusive jurisdiction over any disputes arising from these general subscription conditions and the contracts to which they apply.

Modifications to the Subscription Conditions

We reserve the right to modify this document at any time. The most current version is available at https://rvpsy.com/cgu. It governs our use of your information at any given moment. If we amend these conditions in a way we deem, at our sole discretion, to be substantial, we will notify you by email. By continuing to access or use the application after such changes take effect, you agree to be bound by the provisions set out in the new Subscription Conditions.
